BAY CITY PLANNING COMMISSION

PUBLIC HEARING NOTICE

FOR 

SUBDIVISION PRELIMINARY PLAT #SUB-2025-01

 

The Bay City Planning Commission will conduct a hearing on Wednesday, May 21st at the Ad Montgomery Community Hall located at 5525 B Street, Bay City Oregon. The hearing will begin at 5:30 p.m. with the following matter to be considered:

 

Description of Project 

APPLICATION #SUB-2025-01 FOR A PRELIMINARY PLAT SUBDIVISION for Mistybrook Estates. The applicant is requesting a preliminary plat for a 43-lot subdivision, on a portion of the 32 acres, at property located west of Bewley Street, south of Doughty Road, Bay City, OR 97107, legally described as 1S1002A Tax Lot 4100,in the Moderate Intensity (MI) Zone. 

 

Public Hearing Criteria 

The applicable criteria by which the preliminary plat subdivision application will be evaluated by the Planning Commission are located in the Bay City Development Codes Chapter 10, Section 10.06.050, Moderate Intensity (MI) Zone Area and Standards; Section 10.10.010, Zone Development Standards; Section 10.10.020, Setback Requirements; Section 10.10.30, Landscape, Buffers, Screens and Common Open Space; Section 10.10.040, Fences; Section 10.10.050, Clear Vision Area; Section 10.10.072, Parking Standards; Section 10.10.090, Exterior Lighting Standards; Section 10.10110, Flag Lots; Section 10.10.121, General Requirements; Section 10.10.122, Transportation Impact Studies; Section 10.10.124, Streets; Section 10.10.126, Rights-of-Way and Street Section Widths; Section 10.11.140, Substandard Streets; 10.12, Application and Review Procedures; Section 10.14.100, Subdivision, Partitioning, Cluster and Planned Development. Appeals to the City Council are limited to only persons who have presented written and/or oral testimony at the hearing(s) before the Bay City Planning Commission. 

 

Failure to raise an issue at the public hearing, in person or by letter, or the failure to provide sufficient specificity to allow the Planning Commission an opportunity to respond to the issue, precludes an appeal to City Council on that issue. Unless there is a continuance, if a participant so requests, the record shall remain open for at least seven (7) days after the initial evidentiary hearing. The Planning Commission reserves the right to modify the proposal, or continue the hearing to another date and time.  If the hearing is continued, no further public notice will be provided.

Materials pertinent to the request are available for review at the Bay City, City Hall, 5525 B Street, Bay City Oregon.  A staff report will be available for inspection seven (7) days prior to the hearing and may be obtained at a reasonable cost.  All interested parties are invited to express their opinions for or against the request at the hearing or by letter addressed to the Planning Commission, City Hall, PO Box 3309, Bay City, Oregon, 97107.
