Public Notice of Appeal of Planning Commission Decision #S-2026-01

The Bay City City Council will conduct an appeal hearing on Tuesday, July 14, 2026 at the Ad Montgomery Community Hall located at 5525 B Street, Bay City Oregon. The hearing will begin at 6:00 p.m. with the following matters to be considered:

Appellant 

Security Signs, Cyndi Stocks (applicant) 

Description of Appeal 

This notice announces an appeal filed by Cyndi Stocks, Permits Specialist, Security Signs against a decision by the City of Bay City Planning Commission regarding a specific land use application, Sign Permit #S-2026-01. It is an APPEAL OF PLANNING COMMISSION DECISION TO DENY #S-2026-01 for a SIGN PERMIT for a large sign greater than 32 sq ft, at property located west of Warren Street, south of McCoy Avenue, at 8335 Hwy 101, Bay City, OR 97107, legally described as 1S1002BC Tax Lot 3400, in the South High Intensity (SHI) Zone. 

Original Application #S-2026-01 For A Free-Standing Sign from Security Signs, Inc. The applicant was denied a request to place a larger sign – 7 ft-3 ½ in x 10 ft-4 in (73 sq ft) at 18 ft height to grade, located at 8335 US 101, Bay City, OR 97107, legally described as 1S1002BC03400, in the South High Intensity (SHI) Zone. The Tillamook Smoker Outlet Store is located on the subject property. The size of sign denied is greater than the required 32 square foot single free-standing sign requirements.  

Applicable Criteria 

The applicable criteria by which the larger sign application will be evaluated by the City Council are located in the Bay City Municipal Codes, Section 10.10.100, Signs; Section 10.15.040 Criteria for a Conditional Use Permit, Section 10.15.080 General Conditional Use Standards; and Section10.06.040 South High Intensity (SHI) Zone Standards, Section 10.06.040 High Intensity Zone Standards. 

Procedural Limitations on Appeal 

Oral public testimony will be heard and written public comments will be accepted at or prior to the hearing. If submitting comments prior to the hearing, deliver or mail to the address written below, and please designate on comment letters “Appeal #S-2026-01”, and include your name, mailing address, and phone number. Only comments and testimony on the relevant approval criteria, identified above and within the administrative record on this appeal, shall be considered relevant evidence. 

Failure to raise an issue at the public hearing, in person or by letter, or the failure to provide sufficient statements, evidence, or testimony to afford the City Council an opportunity to respond to the issue, precludes an appeal of City Council’s decision (to the Land Use Board of Appeals) on that issue. 

Following the closure of the public hearing and record on appeal, the City Council will deliberate and reach a decision on the appeal. The City Council’s final decision shall be mailed to the applicant, the appellant, and any other person who submitted written comments or is otherwise legally entitled to notice. 

Unless there is a continuance, if a participant so requests, the record shall remain open for at least seven (7) days after the initial evidentiary hearing. The City Council reserves the right to modify the proposal or continue the hearing to another date and time.  If the hearing is continued, no further public notice will be provided.

Materials pertinent to the request are available for review at the Bay City, City Hall, 5525 B Street, Bay City Oregon.  A staff report will be available for inspection seven (7) days prior to the hearing and may be obtained at a reasonable cost.  All interested parties are invited to express their opinions for or against the request at the hearing or by letter addressed to the City Council, City Hall, PO Box 3309, Bay City, Oregon, 97107.
