The Bay City City Council will conduct an appeal hearing on Tuesday, July 14, 2026 at the Ad Montgomery Community Hall located at 5525 B Street, Bay City Oregon. The hearing will begin at 6:00 p.m. with the following matters to be considered:

Description of Appeal
This notice announces an appeal filed by David and Freynie Gienger against a decision by the City of Bay City Planning Commission regarding High Street access to/from Lot 16 of the Bay Ridge Subdivision. It is an APPEAL OF PLANNING COMMISSION DECISION TO DENY HIGH STREET ACCESS for Lot 16 of the Bay Ridge Subdivision, Bay City, OR 97107, legally described as 1N1034AC Tax Lot 6600.
Arguments Presented in Appeal
Appellant presents the following arguments in appeal: Severe Topographical and Safety Constraints limiting use of easement; Risk to Municipal Infrastructure; Historical Viability of High Street; Previous Permission to Direct Access granted in Recent Past; The Owners of Lot 16 are in full agreement of this appeal.
Original Request for access to/from High Street. The subject property, Lot 16, has an access easement onto Lot 17 for High Street and is requesting direct access to/from High Street rather than use of the easement through Lot 17. The applicant was denied a request for direct access to High Street.
Applicable Criteria
The applicable criteria by which the access is evaluated by the City Council includes: BCMC Section 10.10.121 General Requirements, Existing substandard streets; Declaration 8.03.04 of the Bayridge Covenants, Conditions, Restrictions; Lot 16 access easement across Lot 17 allowing Lot 16 access to/from High Street.
Procedural Limitations on Appeal
Oral public testimony will be heard and written public comments will be accepted at or prior to the hearing. If submitting comments prior to the hearing, deliver or mail to the address written below, and please designate on comment letters “High Street Access”, and include your name, mailing address, and phone number. Only comments and testimony on the relevant approval criteria, identified above and within the administrative record on this appeal, shall be considered relevant evidence.
Failure to raise an issue at the public hearing, in person or by letter, or the failure to provide sufficient statements, evidence, or testimony to afford the City Council an opportunity to respond to the issue, precludes an appeal of City Council’s decision (to the Land Use Board of Appeals) on that issue.
Following the closure of the public hearing and record on appeal, the City Council will deliberate and reach a decision on the appeal. The City Council’s final decision shall be mailed to the applicant, the appellant, and any other person who submitted written comments or is otherwise legally entitled to notice.
Unless there is a continuance, if a participant so requests, the record shall remain open for at least seven (7) days after the initial evidentiary hearing. The City Council reserves the right to modify the proposal or continue the hearing to another date and time. If the hearing is continued, no further public notice will be provided.
