The City of Bay City will hold a Planning Commission Hearing for amendments to the City Comprehensive Plan and City Development Ordinance #374, Phase 2 of the Bay City TGM Development Code Evaluation and Update on the following date:
Wednesday, November 15, 2023, at 5:30 p.m.

The Second Hearing will be at the City Council meeting  on Tuesday, December 12, 2023, at 6:00 pm.

The Bay City TGM Development Code Evaluation and Update project began in 2020 with the objective of removing barriers to creating a vibrant community that supports various modes of transportation. The updated development code incorporated the following changes based on recommendation from the Phase 1 Final Action Plan (April 6, 2021). Modifications were further guided by the Phase 2 Development Ordinance Outline (last revised June 16, 2022). All changes and amendments are based on the currently adopted Development Ordinance, Ordinance 374, with proposed code language drawing from Model Development Code for Small Cities 1 and other sources as necessary.
Changes in this revised draft of the code include:
• Revised structure of Article 5 to improve organization and flow.
• Addition of Middle Housing (triplexes, townhouses, cottage clusters).
• Addition of ADU and Cottage Cluster development standards.
• Updated accessory structure height and size standards.
• Updated flag lot standards.
• Addition of Eating and drinking establishment and Drive In/Drive through siting standards.
• Revised structure of Article 7 Type I review procedures.
• Revised Parking standards.
The Planning Commission Hearing will be held in the Ad Montgomery Community Hall/Council Chambers located at 5525 B Street, Bay City, Oregon.

Residents of the Community are encouraged to attend and the public is welcome to attend.

What is the purpose of the project?

The purpose of the Bay City Code Evaluation and Update project is to make recommended changes to the City’s land use requirements, to help  the City remove barriers to creating a vibrant community that supports various modes of transportation (vehicular, walking, bicycling, etc.).

Proposed modifications will help achieve a mix of building types and uses in the downtown, increase the diversity of housing types available (e.g., single-family homes, apartments, duplexes, townhouses), and improve transportation options in the City.

What will the outcome of the project be?

The project will result in the adoption of an updated Bay City Development Ordinance.

What is the purpose of a development code? Why does the Bay City Development Ordinance need to be updated?

The Bay City Development Ordinance was first adopted in 1978. The age of the document, as well as periodic modifications over the years, have resulted in a document that is not logically organized and is difficult to interpret and use. The review of the Development Ordinance in Phase One of the project helped Bay City realize that improvements could be made to reach its goals and become more walkable and bikeable.

What are some of the major changes expected?

The Development Ordinance will be organized more intuitively, with existing content being reorganized into different chapters and section headings. Important policy changes are expected to include amended parking requirements, an expansion of permitted housing types in certain zones, and siting standards (e.g., lot size, density, setbacks, etc.).

What is the project schedule?

The second phase of the project started in Spring 2022 and is expected to be completed in Winter 2022. Adoption hearings for the code amendments before the Bay City Planning Commission and City Council are expected to occur in the Winter of 2022. The adoption hearings will be announced and open to the public.

A Community Meeting is scheduled for July 2022 where residents, business owners, and interested citizens can review the proposed changes and provide suggestions.

This project is funded by a grant from the Transportation and Growth Management (TGM) Program, a joint program of the Oregon Department of Transportation and the Oregon Department of Land Conservation and Development. 
The program helps governments across Oregon with skills and resources to plan long-term, sustainable growth through land use and transportation planning, consistent with other local planning goals and changing demographics
